Intellectual Property Working Group Meeting

On Tuesday, 23 June 2020 EuroCham Intellectual Property (IP) Working Group held an online meeting via Zoom. The meeting was chaired by Mr. Kin Wah Chow and Mr. Edouard Helfand as the Head and Deputy of the Working Group. The main agenda was a discussion on IP enforcement aspects in the E-Commerce business based on the latest issuance of the Minister of Trade Regulation No. 50/2020 on Provisions on Business Licensing, Advertising, Guidance, and Supervision of Businesses in Trade through Electronic Systems. This regulation requires all merchants to secure a license from the Ministry of Trade, as well as access to an e-commerce platform to report some data to Statistics Indonesia. These requirements would help provide certainty in relation to Intellectual Property protection and enforcement considering that in previous practices, merchant in an e-commerce platform often mask their identity when selling fake products. In this meeting, the Group agreed to further approach the Ministry of Trade to provide their observations and recommendations to ensure that Intellectual Property protection be considered in the implementation of this regulation.

Pharmaceutical and Medical Technology Working Group Meeting

On June 12, 2020, EuroCham hosted the regular meeting of the Pharmaceutical and Medical Technology Working Group to discuss the Minister of Industry Regulation No 16 of 2020 on Provisions and Procedures for Local Content of Pharmaceutical Products, which was just recently enacted on 29 May 2020. This regulation provides the guidelines on how to calculate the local content of pharmaceutical product. The calculation consisting of four aspects, namely raw materials, research and development process, production process, and packaging process, through the scoring calculation.

Some concerns were also conveyed by the participants as an industrial business, and the meeting discussed follow up advocacy plans that need to be carried out in the short to medium term in regards to the issuance of this regulation. The main concerns include the basic clarity related to the definition of domestic industry, and also the best value in each aspect by looking at the characteristics of each pharmaceutical industry in Indonesia. In addition to this, the Group also shared updates on the healthcare sector specifically on the Social Insurance Administration Organization (BPJS) in the era of National Insurance Coverage (JKN).
